The development of the amicus curiae before international tribunals

La naturaleza interestatal del Derecho internacional público ha relegado tradicionalmente el acceso y la participación del individuo en los tribunales internacionales. No obstante, se han establecido instrumentos procesales que permiten su intervención en diversos ámbitos del ordenamiento internacional. Este trabajo analiza la evolución de la institución del amicus curiae en la jurisprudencia internacional, cuyo desarrollo ha facilitado la intervención del individuo ante ciertos órganos internacionales de carácter jurisdiccional.
The interstate nature of Public International Law has traditionally constrained the access and participation of individuals before international courts. Yet, certain procedural avenues, such as the amicus curiae, have been set up so as to flatten the individual’s intervention in several areas of International Law. This paper studies the evolution of the amicus curiae, an institution which has facilitated the intervention of the individual before certain international courts.
