Entre la obsesión por la seguridad y la lucha contra la inmigración irregular: A propósito de la nueva Ley de asilo

Resumen

La presente contribución tiene por objeto el análisis de la nueva ley reguladora del derecho de asilo y de la protección subsidiaria. Adoptada con la finalidad de adaptar nuestro ordenamiento a los desarrollos experimentados por la política europea de asilo, la nueva norma introduce mejoras incuestionables, en especial, la regulación del estatuto de protección subsidiaria y su práctica equiparación al derecho de asilo. La obsesión por preservar la seguridad y por evitar el uso del asilo con fines de inmigración irregular determina, sin embargo, que en el nuevo modelo subsistan unas veces y aparezcan ex novo otras, medidas que resultan discutibles cuando no dificilmente compatibles con la Convención de Ginebra.

Abstract

The goal of this contribution is to analyse the new Spanish law on asylum and subsidiary protection. Adopted last October in order to adapt the Spanish legal order to the European asylum policy developments, the new law introduces unquestionable improvements, particularly, the regulation for the first time of the subsidiary protection status and its practical equalization to the right of asylum. However, the obsession with preserving security, on the one hand, and with avoiding the use of asylum for irregular immigration aims, on the other, bring about the persistence in some cases, and new emergence in others, of measures which are questionable, if not hardly compatible with the Geneva Convention relating to the Status of Refugees.
