El control de convencionalidad en el Derecho español: ¿una importación defectuosa?

The conventionality control under Spanish law: a deficient import?

Resumen

La doctrina del control de convencionalidad era prácticamente ajena al sistema jurídico español. Sin embargo, en la STC 140/2018, de 20 de diciembre, el Tribunal Constitucional ha declarado expresamente que este mecanismo en España constituye una regla de selección de Derecho aplicable, a cargo de la jurisdicción ordinaria. El artículo analiza los antecedentes del control de convencionalidad en el Derecho comparado –con especial énfasis en la jurisprudencia de la Corte Interamericana de Derechos Humanos– y los problemas que esta nueva doctrina constitucional genera en la aplicación del Derecho internacional de los derechos humanos en el Derecho español.

Abstract

: The Conventionality Control doctrine was almost strange to Spanish Law. However, in STC 140/2018, of 20 December 2018, the Constitutional Court of Spain construed that this mechanism is within the powers of Ordinary Judges and constitutes a rule of selection of applicable law. The article analyzes the meaning of the Conventionality Control doctrine from a Comparative law perspective, as well as its scope within the Inter-American Court of Human Rights. It also highlights some concerns regarding the implementation of the mechanism vis à vis the enforcement of International Human Rights Law in the Spanish legal system.
